SparkyApp Terms of Use

Last updated: October 2026

SparkyApp provides tools to assist with customer and job management, surveys, calculations, installation records, certificates and related documentation.

Professional responsibility

SparkyApp is intended for use by suitably competent persons.

The app is a working aid and does not replace professional judgement, appropriate training, manufacturer instructions, legislation, regulations, industry standards or the user's responsibility for work carried out.

Users remain responsible for checking and verifying all information, calculations, test results, installation records, certificates and documents before relying upon, signing or issuing them.

Calculations and generated values

Calculators, suggested values and automatically generated results within SparkyApp are provided as working aids.

The user is responsible for ensuring that:

  • All input information is correct

  • The appropriate calculation or method has been selected

  • The result is reasonable and suitable for the installation

  • The result complies with the current requirements applicable to the work

Automatically generated values should not be relied upon without appropriate professional verification.

Records, documents and certificates

SparkyApp can generate surveys, installation records, certificates, reports and PDF documents using information entered or calculated within the app.

The person completing, signing or issuing a document remains responsible for its accuracy, completeness and suitability.

The presence of a document, calculation or certificate within SparkyApp does not itself demonstrate compliance with any particular regulation, standard, certification scheme or manufacturer's requirements.

Shared workspaces

SparkyApp may allow authorised users within the workspace to access and contribute to shared customers, jobs, surveys, installation records, maintenance records and certificates.

Users are responsible for ensuring that they only access, amend, sign or issue information that they are authorised and competent to deal with.

Where several users contribute to the same job, each user remains responsible for the information and work that they personally enter, verify or sign.

The organisation is responsible for deciding who should be granted access to that workspace.

Data and records

Users are responsible for maintaining any records, supporting evidence or backups required for their own business, regulatory or certification purposes.

Although SparkyApp is designed to store and synchronise information using Apple technologies, no software or cloud service should be treated as the sole permanent archive of important business or compliance records.

Availability and development

SparkyApp may be updated, modified or temporarily unavailable from time to time.

Features, forms, calculations and data structures may change as the app develops.

During TestFlight or other pre-release testing, features may be incomplete, experimental or subject to change and users should take particular care before relying upon information generated by a pre-release version.

Third-party information and services

SparkyApp may use or interact with services provided by third parties, including Apple services such as iCloud and CloudKit.

The availability and operation of those services are outside SparkyApp's direct control and may also be subject to the third party's own terms and policies.

Liability

SparkyApp is a software tool intended to assist professional users.

To the fullest extent permitted by law, the developer will not be responsible for loss or damage arising from:

  • Incorrect, incomplete or outdated information entered into the app

  • Incorrect selection or use of a calculation

  • Failure to verify generated information

  • Improper use of the app

  • Loss of access to data caused by device, account, network or third-party service failure

  • Work carried out contrary to applicable legislation, regulations, standards, certification requirements or manufacturer instructions

Nothing in these Terms excludes or limits any rights or liabilities that cannot legally be excluded or limited.
